Yomep Terms of Service

1. Acceptance of Terms

Welcome to Yomep (“we”, “us”, or “the App”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”) and Yomep when you download, install, access, or use the App. By using Yomep you acknowledge that you have read, understood, and agree to be bound by these Terms as well as all applicable laws and regulations in the jurisdiction where you reside.

2. Service Description

Yomep is a camera and photo-editing experience that delivers AI-assisted blemish correction, localized retouching, and beauty effects on-device. Key features include:

AI-guided localized repair (e.g., blemish removal, dark-circle reduction, smile-line softening, forehead line smoothing).
Beauty controls such as natural skin smoothing, tone balancing, facial detail enhancement, and flush adjustments.
A curated filter system with adjustable intensity for real-time previews.
Camera capture, album import, local saving, and optional in-app purchases for virtual credits or premium effects.

We may enhance, suspend, or discontinue specific features when required by product iteration or regulatory needs, without liability for any resulting impact.

3. Eligibility & User Conduct

By using Yomep you confirm that:

You are at least 13 years old; if under the age of majority in your jurisdiction, you have verified parental/guardian consent.
You have the legal capacity to enter into this agreement and will comply with all laws applicable to your use of the App.

You agree that you will not:

Upload, create, or distribute unlawful, defamatory, harassing, hateful, or sexually explicit content.
Reverse engineer, decompile, or otherwise attempt to derive source code or protected elements of the App.
Use bots, scripts, scraping tools, or any automated systems to access the App.
Infringe upon the intellectual property, privacy, or other rights of any third party.
Violate any export control, consumer, or privacy laws of the territories where you use the App.

4. Account Status

Yomep currently adopts an account-free experience. You can use the App without signing in or creating an account. If account features are introduced in the future, we will provide clear notice and obtain consent before collecting any additional information.

5. In-App Purchases

Premium items (such as virtual credits or enhanced effects) are sold via Apple’s App Store billing system and are subject to Apple Media Services Terms and applicable tax laws. Please note:

Displayed prices include applicable taxes where required and may vary by region or currency.
Virtual items have no monetary value outside the App, are non-transferable, and are not redeemable for cash.
Except where required by law, all purchases are final and non-refundable.
We may adjust offerings, prices, bundles, or promotions at any time.

6. Intellectual Property

All rights, title, and interest in and to Yomep— including software, UI design, illustrations, brand elements, text, and documentation— belong to us or our licensors and are protected by copyright, trademark, and other laws.

Photos and content you create through Yomep remain yours. To provide the services you grant us a limited, revocable, non-exclusive license to process your content solely within your device environment and only to the extent necessary to deliver features or troubleshoot issues.

7. Compliance Statement

Yomep is designed with international privacy and consumer protection principles in mind, specifically the core requirements of:

California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA).
Canada Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant provincial statutes.
Singapore Personal Data Protection Act (PDPA).
Australia Privacy Act and Australian Consumer Law.
European Union General Data Protection Regulation (GDPR) foundational obligations for EEA-based users.

When multiple sets of laws apply, we aim to follow the higher standard with respect to user rights and protections.

8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Yomep is provided “as is” and “as available.” We make no warranties, express or implied, regarding uninterrupted service, error-free operation, compatibility with your device, or meeting your expectations.

We disclaim liability for any indirect, incidental, consequential, or punitive damages arising from your use of the App, loss of data, or inability to access services due to factors beyond our reasonable control (including third-party infrastructure, system maintenance, or regulatory requirements).

9. Termination

We may suspend or terminate your access to Yomep if we believe you have violated these Terms or applicable laws. You may also terminate this agreement at any time by uninstalling the App. Upon termination, any locally stored data will remain on your device until you remove it.

10. Updates to These Terms

We may update these Terms to reflect changes in law, technology, or services. Updated Terms will be posted within the App, and we will use in-app notices for material changes. Continued use of Yomep after updates constitutes acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

Except to the extent local mandatory laws apply, these Terms are governed by the laws of the jurisdiction where our operating entity is established, without regard to conflicts of law provisions. The parties will first attempt amicable resolution; if unresolved, disputes shall be submitted to the competent courts of that jurisdiction.
